Judicial The Judicial has usurped the authority of our Legislative branch. The Problem: - Our American Judicial System has become a flagrant system.
- It is fueling the flames of citizen’s confrontation.
- It is punishing victims instead of criminals.
- It is undermining traditional moral and ethical values.
- And it is destroying the American free enterprise system.
The Cause: - Our courts have often departed from the principles of constitutional law; then by precedent drifted a second, then a third time until intent is no longer recognized.
- American Bar Association members have first loyalty to the bar. (Monopoly union) They are not required to be under oath to the Constitution?
- The Judicial has usurped authority from the congress.
- We have permitted a network of lawyer dominance in all three branches of our government.
- We as citizens have been influenced to move from the higher laws of God to the lower laws of man in determining right and wrong. We have exchanged the God-given common law for an entrapping web of man’s statutory laws.
- The legal system has become an industry – a law unto itself: an unfair power struggle and broken trust now exist between the citizens and the judicial system.
Possible Solutions: - Demand strict interpretation of the United States Constitution by all authorities.
- Enact legislation to eliminate the dominance of lawyers in positions of political leadership. It creates a conflict of interest.
- Embrace the English rule – the loser pays.
- Abolish lawyer advertising (this was permitted under a supreme court decision not a congressional law).
- Elect non-lawyers to the benches of justice. (Constitutionally permitted).
- Minimize the use of lawyers in disputes with your fellow man – I Cor. 6:1-7
- Limit appeals to no more than two appeals within one year of conviction.
- Eliminate the bar association.
- Educate citizens on the fully informed jury (jury nullification - Constitutional).
- Give priority to the higher laws of God instead of the lower laws of man.
